1. Scope

These General Terms and Conditions of Sale (hereinafter the “GTCS”) apply to the purchase of tickets, passes, cards and other admission tickets sold by the Association Everybody’s Perfect as part of the Everybody’s Perfect festival and its other events.

The purchase of a ticket or any other admission ticket implies acceptance of these GTCS.

Certain events included in the Everybody’s Perfect programme may be organised or sold by partners through their own ticketing systems. When a purchase is made from a third party, in particular the Cinémas du Grütli or the Scènes du Grütli, the third party’s terms and conditions of sale apply to the relevant purchase.

Everybody’s Perfect is the organiser and seller of the tickets covered by these GTCS.

Online ticketing is provided through the Ticketack solution, operated by Net Oxygen Sàrl.

3. Ticketing and conclusion of the sale

Tickets may be purchased online as well as at physical points of sale offered by Everybody’s Perfect, subject to availability.

For an online purchase, the person makes their selection, checks the contents of their basket and the information provided, reads and accepts these GTCS and the data protection policy, and then proceeds with payment.

The sale is considered final once payment has been validated. A confirmation is sent to the email address provided when placing the order.

The buyer is responsible for checking the accuracy of the information shown on the confirmation and on the tickets received and for promptly reporting any irregularities.

4. Prices and rates

Prices are stated in Swiss francs (CHF), including all applicable taxes.

Everybody’s Perfect applies a pricing policy aimed at making the festival accessible to as many people as possible. Several rates may therefore be offered for the same screening or event.

The information associated with the different rates — including age, studies, unemployment, AVS, AI or social situation — is intended to guide the public in their choice and contribute to festival statistics and, for certain rates, to public schemes supporting cultural accessibility.

The choice of rate is based on self-declaration. No supporting document is required.

Everybody’s Perfect invites everyone to choose the rate corresponding to their means and situation.

5. Payment

The payment methods available are indicated at the time of purchase and may include Visa, Mastercard, PostFinance and TWINT.

Electronic payments are processed by the payment service providers used by the ticketing system. Everybody’s Perfect does not have access to the complete card details used to make the payment.

The order is only definitively validated once payment has been confirmed.

In the event of a failed or interrupted payment, the presence of tickets in a basket or the receipt of a payment request does not guarantee their definitive reservation.

6. Tickets, passes and admission control

Tickets, Pass Perfect and 5-entry cards have a unique identifier and a QR code for admission control.

A single ticket is valid only for the screening, performance or event indicated on it. Its QR code allows only one admission to the event concerned.

The Pass Perfect allows its holder to reserve several screenings during the festival. The same identifier and QR code are used to check the different reservations made with the Pass.

The 5-entry card allows five admissions according to the terms specified in Article 9.

Admission tickets may be presented electronically or, where applicable, in printed form. Their reproduction, modification, falsification or fraudulent use is prohibited.

In the event of a copied or multiply presented single ticket, only the first validation of the QR code allows access to the relevant screening.

7. Arrival and release of seats

The public is advised to arrive sufficiently early before the start of the screening or event.

Any seat not occupied at the start of the screening or event may be made available again, including when it has been purchased or reserved in advance.

Access to the venue is therefore no longer guaranteed after the start of the screening or event. Late arrival does not entitle the ticket holder to a refund.

Where the conditions of the venue and event allow, the team may nevertheless authorise late entry.

8. Pass Perfect

The Pass Perfect is personal and non-transferable.

It allows its holder to reserve several screenings during the festival, subject to availability. A prior reservation must be made for each desired screening.

The Pass Perfect does not guarantee access to a screening for which no reservation has been made.

At admission control, the Pass QR code is used to verify the reservation corresponding to the screening concerned.

Any seat reserved using a Pass Perfect and not occupied at the start of the screening may be made available again.

Use of the Pass by anyone other than its holder is prohibited.

9. 5-entry card

The 5-entry card entitles the holder to five admissions to the screenings for which it is valid, subject to availability.

A prior reservation must be made for each admission used.

The 5-entry card is transferable and may be used by several people. Several admissions may be used for the same screening, subject to the remaining balance on the card and available seats.

Any exclusions or specific conditions are indicated at the time of purchase.

10. Exchanges and refunds

Except in the situations provided for below, tickets purchased cannot be returned, exchanged or refunded, including in the event of personal inability to attend, an error when placing the order or non-attendance.

In the event of cancellation of a screening or event by Everybody’s Perfect, the tickets concerned will be refunded.

In the event of a change to the date or time, the persons concerned will be informed where possible and may request a refund of their ticket if the change means they can no longer attend the event.

A minor programme change or a change of venue or location does not automatically entitle the ticket holder to a refund, provided that the event can take place under reasonably comparable conditions.

11. Programme changes

Everybody’s Perfect carefully prepares its programme but reserves the right to make changes when circumstances require.

Changes may concern, in particular, a film, additional activity, invited person, meeting, performance, schedule or venue.

The absence or change of an invited person, discussion, activity or other accompanying programme element does not entitle the ticket holder to a refund when the main advertised event can take place.

In the event of a substantial change affecting the main event, Everybody’s Perfect will determine the appropriate arrangements, including a refund where justified.

12. Cancellation or interruption due to exceptional circumstances

In the event of circumstances beyond the control of Everybody’s Perfect that prevent or make it excessively difficult to hold a screening, event or the festival — including a decision by the authorities, security issue, disaster, major breakdown or other unforeseen event — Everybody’s Perfect will inform the public as soon as possible and determine the appropriate measures depending on the circumstances.

When an event is definitively cancelled without an alternative solution, tickets purchased for that event will be refunded.

13. Conditions of access to venues and respect for people

Holders of admission tickets must comply with the rules of the venue hosting the event and with the instructions given by the staff of Everybody’s Perfect and the venue concerned, particularly with regard to safety.

Everybody’s Perfect aims to provide its audiences, invited guests, artists, volunteers and teams with a welcoming and respectful environment. Transphobic, homophobic, lesbophobic, biphobic, racist, sexist and ableist behaviour or remarks, as well as any form of harassment, violence or discrimination, are not tolerated.

Everybody’s Perfect reserves the right to refuse access to or ask any person to leave the venue if their behaviour endangers others, seriously disrupts the event, violates safety rules or contravenes the principles set out above.

In such a situation attributable to the person concerned, no refund will be due.

Any age restrictions applicable to certain events will be indicated where possible on the event page or at the time of sale.

14. Photography and recordings

Unless expressly authorised, the full or substantial recording of films, performances and other works presented as part of the festival is prohibited.

Photographs or recordings may also be made by Everybody’s Perfect or on its behalf during certain events. The terms relating to the use of images that make individuals identifiable are governed by the data protection policy and the applicable rules.

15. Data protection

Personal data collected as part of the ticketing service is processed in accordance with the Everybody’s Perfect Data Protection Policy, available on the website and at the time of purchase.

Online ticketing uses the Ticketack solution, operated by Net Oxygen Sàrl.

Newsletter registration is optional and is subject to a separate choice when placing the order.

16. Liability

Everybody’s Perfect implements the measures reasonably necessary for the proper running of its events and the operation of its ticketing service.

However, it cannot be held liable for disruptions resulting from circumstances beyond its control, subject to mandatory legal provisions.

These GTCS do not limit rights whose exclusion or limitation is prohibited under Swiss law.

17. Applicable law and jurisdiction

These GTCS and the contracts concluded with Everybody’s Perfect are governed by Swiss law.

The place of jurisdiction is Geneva, subject to the mandatory jurisdictions provided for under Swiss law, particularly with regard to contracts concluded with consumers.
